Typographical Errors

In the event that a Bixby & Ball product is mistakenly listed at an incorrect price, Bixby & Ball reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Bixby & Ball reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Bixby & Ball shall issue a credit to your credit card account in the amount of the incorrect price.

Terms Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Bixby & Ball without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Any cause of action or claim you may have with respect to the site {including but not limited to the purchase of Bixby & Ball products} must be commenced within one {1} year after the claim or cause of action arises. Bixby & Ball failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Bixby & Ball may assign its rights and duties under this Agreement to any party at any time without notice to you.

Use of Site

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Bixby & Ball or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. However, even if the third party is affiliated with Bixby & Ball, Bixby & Ball has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Bixby & Ball. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Bixby & Ball seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well {including if a specific link does not work}.

Return Policy

In-Store Purchases

Bixby & Ball will gladly accept returns of merchandise within 14 days of purchase for a full refund made in the original form of payment. Merchandise must be returned in its original, new and unused condition and must be accompanied by original receipt. If returning clothing, merchandise must be unworn, unwashed or defective for refund. Within 30 days of purchase, Bixby & Ball will gladly make an exchange or issue a merchandise credit for the price at the time of the sale {with original receipt} or for the current selling price {without original receipt}. After 30 days, no returns or exchanges will be accepted. All sale items are a final sale and cannot not be exchanged or returned.

Online Purchases

Unless otherwise noted, Bixby & Ball will gladly accept exchanges or returns of merchandise within 30 days of purchase for a full refund made in the original form of payment. Merchandise must be returned in its original, new and unused condition and must be accompanied by original order receipt. If returning clothing, merchandise must be unworn, unwashed or defective for refund. After 30 days, no exchanges or returns will be accepted. All sale items are a final sale and cannot not be exchanged or returned. Shipping costs on returned items will not be refunded or credited.

A pre-paid, pre-addressed shipping label is included in the information packet enclosed in your package. Affix the label to your package, careful to remove or cover the original shipping label. No postage is required; however, the shipping costs will be billed to your credit card. Also, please include your name, contact information and original order receipt.

We carefully package every order, but unfortunately damage can occur in transit. If your order was received damaged, please contact us by emailing orders@bixbyandball.com or calling 858.436.7214 within 48 hours of receipt.  After submitting your return request, we will review the information and provide via email an RMA number and instructions for returning the item. Unfortunately, claims made after the 48 hour window will not be accepted and are unable to be returned.
